Amendments to the Federal Rules of Appellate, Bankruptcy, and Civil Procedure, Effective 12/1/2025

Congress has taken no action on the proposed amendments to the Federal Rules of Appellate, Bankruptcy, and Civil Procedure adopted by the Supreme Court and transmitted to Congress on April 23, 2025. Under 28 U.S.C. §§ 2074 and 2075 and the Supreme Court orders dated April 23, 2025, the amendments govern all proceedings commenced on or after December 1, 2025, and all proceedings then pending "insofar as just and practicable."

The following amended and new rules and forms became effective December 1, 2025:

  • Appellate Rules 6 and 39;
  • Bankruptcy Rules 3002.1 and 8006;
    • Bankruptcy Official Forms 410S1, 410C13-M1, 410C13-M1R, 410C13-N, 410C13-NR, 410C13-M2, and 410C13-M2R; and
  • Civil Rules 16 and 26, and new Rule 16.1.
